Land Referencing

Legal interests in land are held by individuals or organisations. Land referencing is the process of identifying these individuals and organisations and the nature of their legal interest in the affected land, along with any unregistered rights. This is something which DXN Surveyors are able to provide developers to assist with their requirements in order to promote a scheme. 

Option Agreements

Option agreements are documents agreed between landowners and developers which grant the developer a right to purchase, lease or obtain rights in land at any time during an agreed ‘option period’ in return for an ‘option fee’. Option agreements are used where a developer is interested in acquiring land or rights and would use the option period to apply for and secure the necessary planning permissions required to proceed with their development. 

Licenses & Access to Land

Temporary access on to 3rd party land can be required for a number a reasons and durations of time. This can range from basic pedestrian access for environmental surveys to the requirement of long terms construction licences to facilitate major works.

Wayleaves and Easements

Requiring rights for access, services or apparatus over third party land is very common in the infrastructure and utilities sector. These rights are usually secured by means of wayleaves and easements. DXN Surveyors has an extensive experience in negotiating and understanding of these agreements. 

Acquisition & Disposal of Land and Property

Land acquisition is the process of buying the Freehold or taking a Leasehold of a piece of land.

Before instructing solicitors to complete a transfer of property Heads of Terms are required to agree the commercial detail between the parties. This often details restrictions, covenants, rights and responsibilities which both parties must abide by during and after the term.

We have a wealth of experience negotiating Heads of Terms on behalf of clients. 

 Compensation Claims 

Compensation claims usually occur following the installation of new utility services or maintenance of existing assets. We have experience acting for both claimants and compensating authorities in both scenarios.

With the urban expansions of our towns and cities utilities which were installed to avoid developed areas are now becoming increasingly affected. In certain circumstances this can lead to high value loss of development clauses as a result of the inability to develop. DXN Surveyors have experience settling these types of high value claims.
