Why choose Mediation as a form of Dispute Resolution?

Avoids costly court proceedings
Disputes can involve professional and legal arguments which run on for years and rack up significant costs to both sides. Mediation aims to resolve these long running disputes in a short period and in a much cheaper way than taking the matter to arbitration and incurring further professional costs and court costs.

Done without
prejudice
Mediation is done on a without prejudice way which means anything disclosed, accepted, or put forward as an offer cannot be later bought up in court if an agreement is not reached during the process. It therefore allows both sides to make concessions and offers without the worry that it will later hinder their position in any way.

Confidential process
and outcome
Much in the same way as the process is done on a without prejudice manner it is also completely confidential. This is beneficial as it means any resolution remains out of the public domain and avoid unhealthy presidents, unlike if the matter was settled in court. During the procedure anything spoken about with the mediator will remain confidential unless specifically permitted to disclose to the other side.

Allows the parties to agree the outcome
When a matter is referred to arbitration it takes the matter out of both parties control and puts the decision making in the hands of the courts. Not only does this affect the outcome of the dispute but also impacts who is responsible for the other parties costs. Mediation however allows both sides to try and reach an amicable agreement themselves, with the opportunity to agree to an element of give and take in order to move forward.
